Sect. 11 Invoicing, value added tax and statutory retention

(1) Purpose of data processing

We issue an invoice for every order and make it available in your customer account. The invoice contains your name, your billing address, the items purchased and the value added tax applied.

Because we sell digital products to customers throughout the European Union, we are required to determine and document the country in which you are resident in order to apply the correct rate of value added tax. Sect. 12 Licence activation and update checks

(1) Purpose of data processing

Our products are licensed per website. In order to activate a licence, to verify that it is valid and to deliver updates, the WordPress installation on which our product is used connects to our server. In doing so it transmits the licence key, the address of the website on which the product is installed, the product version in use and the IP address of the requesting server.

Please note that this processing concerns the website on which our product is installed. If you install our product on a website which is not your own, the operator of that website should be informed accordingly.

(2) Legal basis

The legal basis for such processing is Article 6 (1) (b) of the GDPR, as the activation and the delivery of updates are part of the contract concluded with us. Insofar as we evaluate activations in order to detect the unauthorised use of licences, the legal basis is Article 6 (1) (f) of the GDPR.

Sect. 13 Affiliate programme

(1) Purpose of data processing

We operate an affiliate programme which allows partners to refer customers to us and to receive a commission for referred sales. When you reach our website through a partner link, we store a cookie on your device which records the partner concerned, so that a subsequent purchase can be attributed to that partner. This cookie is set only if you have consented to it.

Sect. 14 Display of Amazon products

(1) Purpose of data processing

On some pages of this website we demonstrate the product displays which our software generates. These demonstrations show real products from Amazon. The product images shown are loaded directly from Amazon’s servers when the page is displayed, which means that your IP address and information about your browser are transmitted to Amazon. The product links contain a partner identifier which allows Amazon to attribute a purchase to us.

We participate in the Amazon partner programme. We receive a commission on qualifying purchases; this does not affect the price you pay.

(2) Legal basis

The legal basis for such processing is set out in Article 6 (1) (f) of the GDPR.

Sect. 16 Newsletter

(1) Purpose of data processing

You can subscribe to our newsletter, which informs you about our products, updates and offers. To subscribe you provide your e-mail address. We use the double opt-in procedure: after you subscribe, we send you an e-mail asking you to confirm the subscription, and we log the time of the subscription and of the confirmation.

In addition, the transfer is based on the standard contractual clauses of the European Commission.

(5) Duration of Storage

Your e-mail address and the measurement data are stored for the duration of your subscription and are deleted once you unsubscribe. The record documenting your subscription and confirmation is retained beyond that point as evidence that consent was given.

(6) Right of revocation

You may revoke your consent at any time with effect for the future. Every newsletter contains an unsubscribe link for this purpose. Revoking your consent does not affect the lawfulness of the processing carried out before the revocation.

Sect. 17 Rights of the data subject

1. Right of access by the data subject

(3) the controller no longer needs the personal data for the purposes of processing, but you need them to establish, exercise or defend legal claims; or

(4) if you have lodged an objection against the processing in accordance with Art. 21 (1) GDPR and it has not yet been determined whether the legitimate reasons of the controller outweigh your grounds.

Where processing of personal data relating to you has been restricted, such data may, with the exception of storage, only be processed with your consent or for the purpose of establishing, exercising or defending legal claims or for the protecting of the rights of another natural or legal person or for reasons of an important public interest of the Union or of a Member State.

If the restriction of processing has been restricted in accordance with the conditions mentioned above, you will be informed by the controller before the restriction of processing is lifted.

c) Exceptions

The right to erasure does not apply to the extent that processing is necessary:

(1) for exercising the right of freedom of expression and information;

(2) for fulfilment of a legal obligation which requires processing by the law of the Union or of the Member States to which the controller is subject, or for the performance of a task carried out in the public interest or the exercise of official authority transferred to the controller;

9. Automated individual decision-making, including profiling

You have the right not to be subject to a decision based solely on automated processing, including profiling, which has legal effect on you or which significantly impairs you in a similar manner.

This does not apply if the decision:

(1) is necessary for entering into, or performance of, a contract between you and a data controller;

(2) is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard your rights and freedoms and legitimate interests; or

(3) is based on your explicit consent.

However, these decisions may not be based on special categories of personal data in accordance with Article 9 (1), unless point (a) or (g) of Article 9 (2) applies and appropriate measures to safeguard the rights and freedoms and your legitimate interests are in place.

Regarding the cases referred to in (1) and (3), the data controller has to take appropriate measures to safeguard the rights and freedoms and your legitimate interests, at least the right to obtain human intervention on the part of the data controller, to state his or her own position and to contest the decision.

10. Right to lodge a complaint with a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of your personal data infringes this Regulation.

The supervisory authority with which the complaint has been lodged is to inform the complainant on the progress and the outcome of the complaint including the possibility of judicial remedy accordance to Article 78.
